DOMESTIC VIOLENCE IN MICHIGAN
Domestic violence refers to violent criminal offenses that are committed (or attempted) against a person of the same or opposite sex with whom the defendant has a domestic relationship.

A domestic relationship is defined as a relationship with:

  • A current or former spouse
  • A person you currently or formerly dated
  • A person with whom you share a child
  • A person with whom you currently or formerly shared a residence

DOMESTIC VIOLENCE
Assaulting a current or former resident of your household, a spouse or former spouse, someone you have dated or someone with whom you have a child in common is domestic assault. If convicted of domestic violence, a lifetime federal ban on possession or ownership of firearms and ammunition will be imposed in addition to other penalties.. Domestic abuse is separated into two distinct categories.

    Domestic Assault
    An individual who assaults or assaults and batters someone with whom a domestic relationship exists is guilty of domestic assault. This charge does not require injury to the victim.

    The penalties for domestic assault are:
    • Up to 1 year in jail and/or up to a $500 fine for the first conviction
    • Up to 1 year in jail and/or up to a $1,000 fine for the second conviction
    • The third conviction is a felony punishable by up to 5 years in prison and/or up to a $5,000 fine

    Aggravated Domestic Assault
    The crime of aggravated domestic assault is charged when a person sustains injuries that require medical care. This crime does not involve a weapon.

    In addition to possible probation, counseling, community service, etc., the penalties for aggravated domestic assault are:
    • Up to 1 year in jail and/or up to a $1,000 fine.
    • The second conviction is a felony punishable by up to 5 years in prison and/or up to a $5,000 fine

BONDS FOR DOMESTIC VIOLENCE
A person arrested for Domestic Violence cannot be released from jail on an interim bond set by the jail. The person must be held until he or she can be charged, or has an interim bond set by a judge or district court magistrate. The judge or magistrate's interim bond can include conditions such as having no contact with the victim.

COLLATERAL CONSEQUENCES OF A DOMESTIC VIOLENCE CONVICTION
The consequences listed below are not a complete list of the repercussions for someone convicted of domestic violence. Your criminal defense attorney can advise you of all applicable repercussions.

  • A person convicted of a misdemeanor crime of domestic violence is precluded by federal law from possessing a firearm.
  • A person convicted of a felony crime of domestic violence is disqualified from expungement eligibility.
  • Michigan law prohibits anyone convicted of domestic violence from being employed as childcare workers or teachers.

THE FIRST-TIME OFENDER PLEA BARGAIN FOR DOMESTIC VIOLENCE
Michigan also provides a “first-time offender plea bargain” for those charged with domestic assault. This plea bargain requires the consent of both the prosecutor and the victim. If granted, a person charged with assault and battery must plead guilty, but the court will withhold entering judgement. The case is then put on hold while the accused completes a series of conditions ordered by the court—much like probation. The case will then be dismissed once probation is finished. However, if the probation is not completed to the court’s satisfaction, the person may be found guilty and sentenced accordingly.
